(Website Terms of Use and Online Sale Terms)

 

本條款及細則（「本條款」）適用於閣下透過 yumemonsoon.com（「本網站」）瀏覽、使用或向 夢季YUME.MONSOON（商業登記號碼：41329114-000-03-26-6，「夢季」、「本店」、「我們」）購買產品之行為。閣下一經使用本網站或落單訂購產品，即表示同意受本條款約束。如閣下不同意本條款，請勿使用本網站或購買本店產品。

These Terms & Conditions (“Terms”) apply to your browsing, use of, or purchase of products through yumemonsoon.com (the “Website”) operated by 夢季YUME.MONSOON (Business Registration No. 41329114-000-03-26-6) (“Yume Monsoon”, “we”, “us”, or the “Store”). By using the Website or placing an order for our products, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website or purchase our products.

我們致力確保本網站所載之產品說明、圖片及價格準確無誤，惟產品之實際顏色、物料紋理可能因顯示屏幕設定而與圖片略有差異。所有價格均以港元（HK$）標示，並已包括適用稅項（如有），惟不包括送遞費用（如適用，將於結帳時另行列明）。

We take reasonable care to ensure that product descriptions, images, and prices on the Website are accurate. However, the actual colour and material texture of a product may differ slightly from images due to display screen settings. All prices are quoted in Hong Kong Dollars (HK$) and are inclusive of applicable taxes (if any), but exclusive of delivery charges (which, where applicable, will be shown separately at checkout).

我們保留權利，在不作事先通知之情況下更改產品價格，惟已確認之訂單將不受影響。如因系統錯誤導致產品價格顯示錯誤，我們保留權利拒絕或取消有關訂單，並將全額退還閣下已付款項。

We reserve the right to change product prices without prior notice, provided that this shall not affect orders already confirmed. If a product price is displayed incorrectly due to a system error, we reserve the right to refuse or cancel the affected order and will refund any amount already paid in full.

本店不時提供之優惠碼（例如電郵訂閱優惠）受以下條款約束，並須符合香港《商品說明條例》（第362章）就價格及促銷宣傳之相關規定：

Discount codes offered by the Store from time to time (such as the email subscription offer) are subject to the following terms, and are structured to comply with the requirements of the Trade Descriptions Ordinance (Cap. 362) relating to price and promotional representations:

•          優惠碼之有效期、適用產品範圍及最低消費要求（如有）將於發放優惠碼時清楚列明；

•          The validity period, applicable product scope, and minimum spend requirement (if any) of a discount code will be clearly stated at the time the code is issued;

•          除非另有註明，優惠碼不可與其他優惠、折扣或推廣同時使用，每位顧客及每張訂單僅限使用一個優惠碼；

•          Unless otherwise stated, discount codes cannot be combined with other offers, discounts, or promotions, and are limited to one code per customer per order;

•          本店保留權利，在發現優惠碼被濫用（包括但不限於重複註冊、使用虛假電郵地址或轉售優惠碼）時，拒絕接受有關優惠碼或取消相關訂單；及

•          The Store reserves the right to refuse a discount code or cancel the related order if we detect abuse (including but not limited to duplicate registrations, use of fraudulent email addresses, or resale of discount codes); and

•          本店不會提供無法於合理期間及數量內兌現之促銷優惠（即不進行「誘餌式廣告」），惟如個別產品因供應鏈因素而缺貨，我們將於本網站或於結帳時清楚告知。

•          The Store will not advertise promotional offers that cannot be honoured within a reasonable period and in reasonable quantities (i.e., we do not engage in “bait advertising”); however, if a specific product is out of stock due to supply chain factors, this will be clearly indicated on the Website or at checkout.

閣下於本網站提交訂單，僅構成向本店發出之購買要約（offer），並非本店之接受（acceptance）。買賣合約僅於本店向閣下發出「已確認出貨」或同等效力之電郵通知後，方告成立。本店保留權利，因產品缺貨、資料錯誤或其他合理原因，拒絕或取消任何訂單，並將全額退還已付款項。

Submission of an order through the Website constitutes an offer to purchase made by you to the Store, and does not constitute acceptance by the Store. A binding contract of sale is formed only when the Store sends you an email confirming that the order has shipped or an equivalent notice of acceptance. The Store reserves the right to refuse or cancel any order due to product unavailability, pricing errors, or other reasonable grounds, and will refund any amount already paid in full.

本網站之付款服務由 Airwallex（或本店不時採用之其他持牌付款服務商）處理。閣下之付款卡資料由該付款服務商直接收集及處理，本店不會直接接觸或儲存閣下之完整付款卡號。閣下確認提供予付款服務商之付款資料真實、準確及屬閣下本人所有或已獲授權使用。

Payment on the Website is processed by Airwallex (or such other licensed payment service provider as we may adopt from time to time). Your payment card details are collected and processed directly by that payment service provider, and the Store does not directly access or store your full payment card number. You confirm that the payment information provided to the payment service provider is true, accurate, and that you own or are authorised to use the relevant payment method.

送遞時間表僅供參考，實際送遞日期可能因物流商安排、公眾假期或不可抗力事件而有所延誤。貨品之風險（包括意外遺失或損毀之風險）於貨品交付予閣下或閣下指定之收貨人時轉移予閣下；貨品之所有權則於本店已全數收妥有關款項後方告轉移。

Delivery timeframes are indicative only; actual delivery dates may be delayed due to courier arrangements, public holidays, or events of force majeure. Risk in the goods (including the risk of accidental loss or damage) passes to you upon delivery of the goods to you or your nominated recipient; title to the goods passes only once the Store has received payment in full.

根據香港《商品說明條例》（第26章），本店所售之貨品須（i）具備令人滿意之品質；(ii) 適合其通常用途或閣下已向本店表明之特定用途；及 (iii) 與其說明及／或樣本相符。本條款並無意圖排除或限制上述法定隱含條款；根據《管制免責條款條例》（第71章），任何試圖排除或限制消費者上述法定權利之條款均屬無效。

Under the Sale of Goods Ordinance (Cap. 26), goods sold by the Store must (i) be of satisfactory quality; (ii) be fit for their usual purpose or any particular purpose you have made known to us; and (iii) correspond with their description and/or sample. Nothing in these Terms is intended to exclude or restrict the foregoing statutory implied terms; any term purporting to exclude or restrict a consumer's statutory rights as set out above shall be void pursuant to the Control of Exemption Clauses Ordinance (Cap. 71).

本網站之所有內容，包括但不限於文字、圖像、標誌、產品設計及版面編排，均屬本店或其許可人所有，並受香港版權及商標法例保障。未經本店事先書面同意，閣下不得複製、分發、修改或用於商業用途。

All content on the Website, including but not limited to text, images, logos, product designs, and layout, is owned by the Store or its licensors and is protected under Hong Kong copyright and trade mark laws. You may not reproduce, distribute, modify, or use such content for commercial purposes without the Store's prior written consent.

在香港法例許可之最大範圍內，本店對於因使用本網站或本店產品而引致之任何間接、附帶或衍生性損失概不負責。惟本條款並不排除或限制本店因疏忽引致人身傷亡之責任，亦不排除或限制上文第七部分所述之法定隱含條款下之責任，或任何在香港法例下不可被排除或限制之其他法定責任。

To the maximum extent permitted under Hong Kong law, the Store shall not be liable for any indirect, incidental, or consequential loss arising from use of the Website or our products. Nothing in these Terms excludes or limits the Store's liability for death or personal injury caused by negligence, nor does it exclude or limit liability under the statutory implied terms referred to in Part 7 above, or any other statutory liability that cannot be excluded or limited under Hong Kong law.

本條款受香港特別行政區法律管轄並按其詮釋。任何因本條款而產生或與本條款有關之爭議，雙方同意提交香港法院專屬管轄，惟不影響閣下作為消費者根據香港法例可享有之其他法定權利或救濟途徑。

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Hong Kong, without prejudice to any other statutory rights or remedies you may have as a consumer under Hong Kong law.

本店保留權利，因應法例、業務或營運需要不時修訂本條款。修訂後之條款將於本網站刊登並註明生效日期，惟不影響修訂前已成立之訂單所適用之條款。

The Store reserves the right to amend these Terms from time to time to reflect changes in law, business, or operational requirements. Amended Terms will be posted on the Website with an updated effective date, but shall not affect the terms applicable to orders already formed prior to such amendment.
